American Law Institute, Restatement of the Law, Second: Torts 2d (Call Number: KF 1249 .A4 A428 Law Reserve*). The official text of the Restatement (Second) of Torts including comments, illustrations, and cases.

American Law Institute, Restatement of the Law, Torts: Products Liability (1998) (Call Number KF 1296 .R474 1998 Law Reserve). The Restatement (Third) of Torts is being issued in piecemeal fashion, unlike the Restatement (Second) of Torts.

American Law Institute, Restatement of the Law, Torts: Apportionment of Liability (2000) (Call Number: KF 1312 .R74 2000 Law Reserve) This is part of the Restatement (Third) of Torts.

Treatises

Dan Dobbs, The Law of Torts (Practitioner Treatise Series, 2001, updated with pocket parts.) (Call Number: KF 1250 .D562 2001 Law Open Reserve). This is a two-volume version of the same author's hornbook. The difference is that this "treatise" will be regularly updated with new cases and entries while the hornbook probably won't.

Fowler V. Harper, et al., The Law of Torts (2d ed. 1986, regular updates) (Call Number: KF 1250 .H35 1986 Law Stacks) Note: A third edition is in progress. As volumes of the 3d edition are released, they are supplanting the volumes of the 2d edition on the shelf. So far, only volume 1 of the 3d edition has been released.

Some professors have placed their old exams on reserve at the Zief Library's Circulation Desk. Ask at the desk by course name or professor's name.

Because Torts is both a California Bar Exam essay topic and a Multistate Bar Exam topic, some bar examination preparation material is also listed here. Note that some of the bar examination material may have a different focus than what your professor may be looking for. What Is Torts

The law of torts is the area of law that covers when we hold one person responsible for injuring another person. What if an injury is deliberate? What if an injury is unintentional? What damages can be recovered by the person who is injured? Can a person recover for non-physical injuries? An introduction to the issues involved in Torts can be found in Jay M. Feinman's Law 101. Read Chapter 5, "Auto Accidents, Scalding Coffee, and Medical Malpractice: Personal Injuries and Tort Law" (Call Number: KF 387 .F45 2006 Law Open Reserve ).

For a "big picture" view of the tort litigation system that is more advanced than Law 101 and gives insight into the issues behind why the system works as it does, try Peter A. Bell, Jeffrey O'Connell, Accidental Justice: The Dilemmas of Tort Law (Call Number: KF 1250 .B4 1997 Law Stacks).
